Education and Care Services National Regulation

The Education and Care services National regulation comes into effect on 1 January 2011. NSW OSHC services have never been regulated before. To assist services to adapt to the new regulations there are transitional arrangements in place.

Download your own copy of the regulations. Note in the regulations that OSHC services are referred to as ‘centre based services’ (over pre school age) and ‘out of scope’ services.

Every OSHC service should have a copy of these regulations on site at all time.

11. First Aid Qualifications to meet National Regulations

At least one educator on duty must hold senior first aid qualifications at your service.
The NSW Regulatory Authority has confirmed the Senior First Aid competencies in either:

  • HLTFA402C Apply Advanced First Aid and
  • HLTFA402B Apply Advanced First Aid

BOTH meet the National Regulation 136 (a) as an approved first aid
qualification. Both of these qualification include an asthma and an
anaphylaxis component which are additional requirements for the National
Regulation in regulation 136 ( b and c). Please check your first aid
certificates to ensure they have one of these codes on them.

Any person who currently holds an approved first aid certificate as per the
list on the website (under qualifications

) will continue to be approved into 2012 and until the
certificate expires then that person will need to go to the ACECQA website
listing and ensure they renew with one of the courses that will be published
on this site.The approved courses for anaphylaxis and Asthma training are
published on the ACECQA website.

Please note that services have until 2013 to have someone trained in Asthma
management and anaphylaxis management training as per regulation 246 (2) and
247 (2)

2. Information for Educators

An Educators guide is being developed and due for release in February 2012. COMING SOON!

National Quality Standard

The National Quality Standard is the national benchmark for the quality of education and care services including OSHC.

The National Quality Standard comprises 7 quality areas. The seven quality areas in the National Quality Standard are:

  • Educational program and practice
  • Children’s health and safety
  • Physical environment
  • Staffing arrangements
  • Relationships with children
  • Collaborative partnerships with families and communities
  • Leadership and service management.

Each quality area consists of 2 or 3 standards. There is a total of 18 standards. Within each standard there are elements. There is a total of 58 elements.

Assessment and Rating

The Assessment and Rating System is described in Chapter 3 of the Education and Care Services National Regulation.

All OSHC services will be assessed and rated on the 7 quality areas in the National Standard.
